NeaFit
NeaFit Subscription Terms
v1.0 · Business subscriptions billed in USD · Operated by FitCo
These Subscription Terms (the "Terms") are an agreement between FitCo (CEO Yelim Cho; "we,"
"us," or "the Company") and the business that subscribes to the NeaFit AI size and fit
recommendation service (the "Brand" or "you"). They govern paid NeaFit plans purchased in US
dollars. Shoppers who use the widget on your storefront are covered by the separate
NeaFit Terms of Service and Privacy Policy.
Article 1 (How the agreement starts)
- You apply for NeaFit, and we review and approve your application. On approval we create
your brand account and issue a site ID and an admin login.
- Approval does not start a paid plan or a free trial. NeaFit does not offer a free trial.
The widget on your storefront goes live only after your first plan payment is confirmed.
- The agreement for a paid plan is formed when you choose a plan in the Brand Admin, accept
these Terms (including the automatic renewal terms in Article 3), and complete payment.
Article 2 (Plans, fees, and payment)
- Plans are Basic and Premium, billed monthly, and Enterprise, which is priced and contracted
separately. Current prices and usage allowances are shown in the Brand Admin → Plan page
before you pay. Current list prices: Basic USD 49 per month, Premium USD 99 per month.
Plans are sold on monthly billing only.
- All prices are in US dollars and exclude applicable taxes. Payments are processed by Polar
Software Inc. ("Polar"), which acts as the merchant of record: Polar calculates, collects, and
remits any applicable sales tax, VAT, or GST, charges your payment method, and emails you a
receipt for every charge. We do not store your card details.
- Add-on pack: Premium subscribers can buy a one-time add-on of 300 uses for USD 39 (plus
applicable tax). Packs apply to the current month's allowance only, do not carry over, and are
not subscriptions — they do not renew.
Article 3 (Automatic renewal — please read)
Your plan is a subscription that renews automatically. Unless you cancel, we will
charge the payment method on file the then-current plan price (Basic USD 49 or Premium USD 99,
plus applicable tax) every month on the same calendar day as your first payment, until
you cancel. To cancel, sign in to the Brand Admin and open Billing → Cancel.
- There is no minimum term. Each renewal starts a new one-month billing period.
- How to cancel: sign in to the Brand Admin, open Billing → Cancel, and confirm.
Cancellation takes effect at the end of the billing period you have already paid for; you keep
using NeaFit until then, and you will not be charged again. You can undo a scheduled
cancellation from the same page any time before the period ends. You can also cancel by
emailing hello@neafit.xyz from your registered admin
email; we will confirm within one business day (KST).
- Before your first payment, the Brand Admin shows these renewal terms next to a checkbox.
Checking the box and continuing to checkout is your affirmative consent to these Terms and to
automatic renewal. After payment, Polar's receipt email and the Brand Admin (Billing page) give
you a record of the plan, the price, the renewal date, and the cancellation method.
Article 4 (Usage allowances)
- Each plan includes a monthly allowance of uses (size recommendations and chat replies
combined): Basic 200 per month, Premium 500 per month. Enterprise allowances are set in the
Enterprise contract.
- The allowance resets on the 1st of each calendar month (Korea Standard Time, UTC+9).
If your first payment falls mid-month, your first month runs only until that reset. If you feel
your first month was cut short, contact us and we will adjust it manually.
- We notify you when you reach 80% of your allowance. Reaching the allowance does not stop
the service and does not trigger extra charges. If usage reaches 120% of the effective
allowance, the widget pauses for the rest of the month and resumes automatically at the next
reset. You can raise the allowance by upgrading or, on Premium, by buying an add-on pack.
Article 5 (Plan changes and cancellation)
- Upgrade (takes effect right away). Moving to a higher plan is a new purchase: the
new plan is charged in full on the day you upgrade, your billing date resets to that day, and
the remaining time on your previous plan is replaced by the new plan. There is no refund or credit for the unused part of the previous plan.
Your current plan ends when the new payment completes; if you leave the checkout before paying,
nothing changes and your current plan continues.
- Downgrade (takes effect at the end of the billing period). Moving to a lower plan
does not happen mid-period. To downgrade, cancel your current plan in Billing → Cancel
(Article 3.2); you keep your current plan until the end of the period you have paid for. When that period ends, choose the new plan on the Brand Admin → Plan
page; the widget resumes as soon as that payment completes.
- Cancellation takes effect at the end of the current billing period (Article 3.2). The
service stays on until then.
- When the paid period ends after a cancellation, the widget on your storefront stops working
and the Brand Admin shows no active plan. Your data is kept as described in Article 8.
Article 6 (Refunds)
- Monthly plans are not refunded for the period already paid. Cancel before the renewal date
to avoid the next charge.
- Add-on packs are not refundable once purchased.
- Nothing in this Article limits refund rights you have under applicable law that cannot be
waived.
Article 7 (Failed payments and suspension)
- If a renewal payment fails, Polar retries the charge and emails you according to its
payment-recovery (dunning) schedule. The service stays on while retries continue. You can
update your card at any time in the Brand Admin under Billing → Manage payment method.
- If the retries fail and Polar ends the subscription, the widget is paused and the Brand
Admin shows no active plan. It resumes as soon as a new payment succeeds.
- We may suspend the service after notice if you materially breach these Terms (for example,
by providing false information or abusing the system).
Article 8 (Data)
- You can view your store's consultations, reviews, and statistics in the Brand Admin. So that
your team can answer size questions, conversation records show the height, weight, and usual
size a shopper entered, together with the conversation, under an anonymous ID or an
automatically generated display name. They never show a shopper's name, email address, or
other contact details. You may use this information only to answer shoppers' size and fit
questions on your store, and you must not try to identify individual shoppers from it. Other
statistics are provided in aggregated form.
- You agree that we collect and process your product information (size charts and product
detail images) to generate recommendations.
- When the agreement ends, we delete your brand data after the retention period stated in our
Privacy Policy, except where we are required by law to keep it
longer.
Article 9 (Content you provide)
You are responsible for the lawfulness of content you enter in the Brand Admin, such as fit
guides and FAQ answers (including advertising and consumer-protection rules that apply to you).
We may hold back content we consider inappropriate.
Article 10 (Changes to these Terms or prices)
- We may update these Terms. We will post the updated version at this address and notify your
admin email at least 30 days before a material change takes effect.
- Price changes never apply silently. If we change the price of your plan, we will
notify your admin email at least 30 days before the first renewal at the new price, and the
notice will explain how to cancel before it applies. Continuing past that renewal date means
you accept the new price.
Article 11 (Disclaimer and limitation of liability)
- Recommendations are AI-generated estimates. We do not guarantee any particular conversion
rate, return rate, or business outcome.
- Except where we act with intent or gross negligence, our total liability to you under these
Terms in any 12-month period is limited to the fees you paid us in that period.
- Issues on your own storefront (outages, theme errors, or changes that break the widget
snippet) are your responsibility.
Article 12 (Governing law and disputes)
These Terms are governed by the laws of the Republic of Korea, without regard to its
conflict-of-laws rules. Disputes are brought before the court that has jurisdiction under Korea's
Civil Procedure Act.
